At first sight constitutionalism appears to be a key concept in public law discourse in the United Kingdom. It appears in all the major academic discussions from the rule of law and judicial review to the ‘new constitutional settlement’ and in relation to constitutional culture. And yet attempts to define the scope, meaning and role of constitutionalism remain vague. This article discusses the different fields in which constitutionalism is discussed and the different meanings that are attributed to the concept. It (...) shows that constitutionalism is routinely conflated by public law scholars with other constitutional values and principles, like the rule of law or separation of powers. This article argues that constitutionalism should either be conceived as distinct from those concepts or, failing that, can safely be eliminated from public law discourse. The article concludes by asking whether a nuanced and normative discussion of constitutionalism could have any meaningful application in the United Kingdom constitution. (shrink)

We propose that doping be legalized under medical supervision. First, we discuss two motivations for allowing medically supervised doping. We reject the ‘compromised choice/harm minimization’ motivation as unlikely to win the support of athletes. We agree that it could lead to an arms race. Instead, we favor full acceptance of doping under medical supervision and answer Reid’s spirit of sport objection to medical manipulation. After presenting a set of guiding principles, we use them to answer the arms race objection and (...) rebut one of the most prominent objections in the literature about the safety of medically supervised doping, the game-theoretic objection. Antidoping policy regulates and punishes the use of substances that are listed on a Prohibited List (PL). These substances are colloquially known as ‘performance-enhancing substances’. There is very little empirical evidence of enhancement for most of the substances on the PL raising the possibility that the perceived enhancement of performance experienced by an athlete is a placebo effect. A placebo effect is a response to an inert substance that is strongly influenced by psychological and social cues in the surrounding environment. (...) It is our contention that, given the lack of proper empirical testing of the substances on the PL, it is in fact the appearance of a substance on the PL that has the strongest performance-enhancing effect in elite athletes. This disconnect between science and WADA’s code raises the question of what we really object to: real performance enhancement achieved using substances on the PL or performance enhancement that occurs because WADA has told us that the substance will enhance performance by placing it on the PL? In this case, antidoping policy would punish those who believe the performance-enhancing myth at the heart of the PL thus leading to a deeply flawed policy that creates its own victims. (shrink)

Eric Voegelin (1901-1985) zahlt zu den prominentesten Vertretern einer neoklassischen politischen Philosophie im 20. Jahrhundert. Wesentliche Grundlagen seiner politischen Theorie entwickelt Voegelin in der Auseinandersetzung mit der staatstheoretischen Debatte der 1920er- und 1930er-Jahre und im Versuch der Grundlegung einer "Staatslehre als Geisteswissenschaft". Im weiteren Verlauf seiner theoretischen Arbeit erscheint ihm der Begriff des Staates als politiktheoretische Fundamentalkategorie aber zunehmend fragwurdig. Im Sinne der Leitfrage der Reihe Staatsverstandnisse, was sich den Ideen von Staatsdenkern fur ein zeitgemasses Verstandnis des Staates entnehmen (...) lasst, erweist sich Voegelins Beitrag als das zunachst staatstheoretisch inspirierte Projekt einer Dekonstruktion des Staatsbegriffs und der Entfaltung ihrer theoretischen Konsequenzen - von der Herausarbeitung der im Staatsbegriff enthaltenen, aber verschleierten Verhaltnisbestimmung zwischen Politik und Religion bis hin zum Entwurf einer politischen Theorie als "Ordnungswissenschaft". Since the first edition of this work, _Checklist of Writings about John Dewey, 1887–1973, _appeared in 1974, more_ _than three hundred new works—pub­lished and unpublished—about John Dewey have been written. In addition, many items from the years covered by the first edition have been discovered. All these writings are listed here in the “Supplement to the First Edition,” which, like the earlier edition, is thor­oughly indexed by author and by title. As the first exhaustive compilation of information about such works, (...) the _Checklist, _now comprising more than twenty-five hundred entries, will be the indispensable starting point for future scholarly study of any facet of Dewey’s career. The belief in free will has been frequently challenged since Benjamin Libet published his famous experiment in 1983. Although Libet’s experiment is highly dependent upon subjective reports, no study has been conducted that focused on a first-person or introspective perspective of the task. We took a neurophenomenological approach in an N = 1 study providing reliable and valid measures of the first-person perspective in conjunction with brain dynamics. We found that a larger readiness potential is attributable to more frequent occurrences (...) of self-initiated movements during negative deflections of the slow cortical potentials . These negative deflections occur in parallel with an inner impulse reported by an expert meditator which may in turn lead to a voluntary act. We demonstrate in this proof-of-principle approach that the first-person perspective obtained by an expert meditator in conjunction with neural signal analysis can contribute to our understanding of the neural underpinnings of voluntary acts. McCullough, Kilpatrick, Emmons, and Larson (2001) posited that gratitude prompts individuals to behave prosocially. However, research supporting the prosocial effect of gratitude has relied on scenario and self-report methodology. To address limitations of previous research, this experiment utilised a laboratory induction of gratitude, a method that is potentially more covert than scenarios and that elicits actual grateful emotion. Prosocial responses to gratitude—operationalised as the distribution of resources to another—were paired with a self-report measure of gratitude to test the prosocial effect (...) of gratitude. To investigate positive mood as an alternative explanation, this experiment compared responses of individuals receiving a favour to responses of individuals receiving a positive outcome by chance. A total of 40 participants were randomly assigned to either a Favour or Chance condition. Participants receiving a favour helped more and reported more gratitude compared to participants in the Chance condition. (shrink)

In this essay I propose to explicate and defend a new and improved version of a Lockean proviso—the self-ownership proviso . I shall presume here that individuals possess robust rights of self-ownership. I shall take it that each individual has strong moral claims over the elements which constitute her person, e.g., her body parts, her talents, and her energies. However, in the course of the essay, I shall be challenging what I take to be the standard conception of self-ownership and (...) proposing an enrichment of that conception. The SOP is presented and in part justified as an implication of the right of self-ownership as it is more richly conceived—hence its designation as the self-ownership proviso. As an implication of the right of self-ownership which is also compatible, in theory and practice, with extensive and robust private property rights, the SOP is offered as an integral element of classical-liberal political theory. Eine anschliessende ausfuhrliche Rekonstruktion der Identitatstheorie G. H. Meads fuhrt zu einer kritischen Differenzierung von selbstbewusster,Identitat' und asthetischem bzw. asthetisch-existenziellem,Selbst'. Letztere werden als Momente einer unhintergehbaren Selbstfremdheit des Subjekts erkannt, welche es in Theorie und Praxis zu berucksichtigen gilt.

The process of optimizing psychical distance to achieve the best possible aesthetic effect has been well-known among philosophers of art ever since Edward Bullough formulated the concept in 1912. Although it is typically analyzed as a one-way process, it nevertheless becomes a reciprocal or intersubjective process when the object of our aesthetic perception is our “other.” This is equally true for animal “others” as for our fellow human “others.” Anything animate can fix us in its gaze and thereby prompt or (...) even force us toward self-confrontation as an object of someone or something else’s perception. This reciprocity may be manifest as a sort of psychological pas de deux between the two confronting subjects, each confronting the other as object, each recognizing the other as subject, and each confronting its own self as recognizer of this relationship and recipient of this attention. The level of our awareness of our being an object for some “other” subject has a proportionately significant impact on our aesthetic perception of this “other, ” i.e., the fact that an “other” perceives us adds a dimension of “unnatural” intersubjectivity which changes our aesthetic appreciation of that “other.”. But the right to reasonable compensation within a nationalized health care system is not on the same moral plane as the public's right to health care. While the extended cognition (EC) thesis has gained more followers in cognitive science and in the philosophy of mind and knowledge, our main goal is to discuss a different area of significance of the EC thesis: its relation to philosophy of science. In this introduction, we outline two major areas: (I) The role of the thesis for issues in the philosophy of cognitive science, such as: How do notions of EC figure in theories or research programs in cognitive science? Which (...) versions of the EC thesis appear, and with which arguments to support them? (II) The potentials and limits of the EC thesis for topics in general philosophy of science, such as: Can naturalism perhaps be further advanced by means of the more recent EC thesis? Can we understand “big science” or laboratory research better by invoking some version of EC? And can the EC thesis help in overcoming the notorious cognitive/social divide in science studies? Among the letters, memorabilia, manu­scripts, films, and tapes in the eighty-four warehouse boxes of the John Dewey Papers that came to Southern Illinois University at Carbondale in 1972 were a number of boxes that contained the books and journals from Dewey’s personal and professional library. The circumstances surrounding the growth of that library were these: after John Dewey died in 1952, the second Mrs. Dewey, Roberta Grant Dewey, continued to live in the same apartment with the couple’s two adopted children. (...) Upon her death in 1970, the household was dismantled and all the books there were packed away. The library therefore comprises the many volumes col­lected through the years by the two families of John Dewey: the first, John and Alice Chipman Dewey and their children—Lucy, Evelyn, Jane, Fred, Gordon, and Sabino; the second, John and Roberta Dewey and their adopted children—Adrienne and John, Jr. In addition to the books signed or anno­tated by Dewey—well over a hundred have marginalia—or inscribed to him, a number of books with the names of other family members have been included in this checklist because evidence exists that Dewey also used them; others have been included because they were available for possible use. Only school textbooks have been excluded. The checklist is divided into two basic sections: works in English and works in other languages; entries in both sections are anno­tated to indicate Dewey’s notes, marginalia, inscriptions, and similar information. Beyond its use as a research tool, both in editing the Collected Works and in verifying Dewey’s references, this checklist of Dewey’s library provides interesting, often important, insights into his life and work. Augustin a commencé de s'intéresser aux questions de l'âme, de sa nature, de son origine et de son destin sous le double horizon des croyances manichéennes, auxquelles le tenait attaché son obsession du problème du mal et du salut, et des doctrines néoplatoniciennes, en qui il trouvait une certaine parenté avec la spiritualité chrétienne. Le néoplatonisme l'aidait à concevoir l'immortalité de l'âme, mais en rejetant sa consubstantialité avec Dieu, à écarter aussi le dualisme manichéen tout en professant la dualité ontologique (...) de Dieu et du créé, et de l’âme et du corps. Mais l'Écriture se dissocie du platonisme quand elle montre que l'âme ne peut pas remonter par ses seules forces jusqu'au vrai et au bien et qu'elle a besoin du secours de la grâce et des sacrements. L'Écriture érige des réalités d'ordre sotériologique étrangères aux spéculations des philosophes, elle fait du péché une réalité originelle et universelle, dont la transmission relance la question de l'origine des âmes : préexistantes, ou créées à la naissance ou issues de celles des parents ? Il pense que ni l'Écriture ni la philosophie ne permettent de trancher entre le créationisme et le traducianisme, mais il s'efforce de concilier, sans y parvenir tout à fait, le plan anthropologique avec le plan sotériologique. Augustine began his interest in the nature, origin, and destiny of the soul under the double influence of Manichaean beliefs , and Neoplatonic doctrines, in which be found a certain relation with Christian spirituality. Neoplatonism helped him to conceive the immortality of the soul, but by rejecting its consubstantiality with God, and also to set aside Manichaean dualism while professing the ontological duality of God and the created, as well as the soul and body. But Scripture disassociates itself from Platonism when it shows that the soul cannot, by its own power, arise to the true and the good, but needs help from grace and the sacraments. Scripture builds its realities around soteriology, which is foreign to the speculations of philosophers. It makes sin an original and universal reality, whose transmission brings up again the origin of souls : pre-existent, created at birth, or issuing from those of its parents ? Augustine thus ties together the two questions of the origin of evil and that of souls, especially in the third book of the treatise On Free Will . He thought that neither Scripture nor philosophy helped to decide for creationism and traducianism, but he made an effort to reconcile, without complete success, the anthropological dimension with the soteriological dimension.
